Cheap international calls: EU Court of Justice backs price caps

The highest court in the EU has ruled that the European Commission is justified in pushing for a price cap on international mobile phone calls.
The EU’s Court of Justice stated that legislation on 'roaming' call charges, which was introduced in 2007 and expanded last year to also cover text messaging and data downloading from the internet, was justified.
In a statement a spokesperson for the court commented: "The roaming regulation is valid. The community had the right to impose caps on the prices charged by mobile telephone operators for roaming calls in the interest of the internal market."
The body added that the high level of retail charges had been regarded as a persistent problem by public authorities.
The court added that EU-wide regulations prevented national governments from taking go-it-alone measures, stating that they may prove disruptive to the orderly functioning of the community-wide roaming market.
Four of Europe's largest mobile telecom operators -Vodafone Group, Telefonica's O2, Deutsche Telekom's T-Mobile and France Telecom's Orange - challenged the EU Court of Justice over the price caps, claiming that the European Commission had overstepped its powers in proposing the legislation and that the limits imposed were disproportionate.
